Who Can Use the H-2A Program?
H-2A is for U.S. agricultural employers with a temporary or seasonal need for farm or ranch labor when enough qualified U.S. workers are not available. The program has no annual numerical cap. Workers are commonly authorized for seasonal stays of up to about 10 months, depending on the approved period of need.

What Employers Must Meet

You must show a temporary agricultural need—seasonal, peak, or otherwise time-limited—not permanent year-round staffing through H-2A alone.
Recruitment of U.S. Workers
Employers must recruit U.S. workers in good faith and follow required advertising and hiring steps before relying on H-2A labor.
AEWR and Required Wages
Pay at least the Adverse Effect Wage Rate or other applicable required wage, whichever the rules require for the role and location.
Free Housing
Provide housing at no cost to H-2A workers that meets applicable federal and local standards and inspections.
Transportation Obligations
